Creator Program Terms

These terms govern participation in the ECSO CLOUD Creator Program, in which creators recommend our services with a personal code and receive credit in return.

01Scope

These terms apply to the participation of creators (hereinafter "Creator") in the Creator Program of ECSO CLOUD (hereinafter "we" or "us"). In addition, our Terms of Service apply. In the event of contradictions, these terms take precedence.

02Participation

2.1

Participation requires an application and our acceptance. There is no entitlement to admission; we may reject applications without giving reasons.

2.2

The Creator must be at least 18 years old, have a verified customer account with us and provide correct and complete information. Changes must be reported to us without undue delay.

03Creator Code

3.1

After acceptance, the Creator receives a personal creator code. The discount rate is agreed individually between 5% and 20% and is shown in the creator area of the customer account.

3.2

Customers who apply the code to an open invoice receive a discount in the amount of the agreed rate on the invoice amount. Only one code can be used per invoice, and it cannot be combined with credit on the same invoice.

3.3

The code is personal and may not be transferred to third parties. The Creator may not use the code for their own invoices or for invoices of customer accounts they control.

04Remuneration

4.1

For each invoice paid using the code, the Creator receives credit in the amount of the discount granted to the customer. The credit is booked to the Creator's customer account as soon as the invoice has been paid in full.

4.2

If a payment is subsequently reversed, refunded or charged back, or if the contract is withdrawn, we may cancel the corresponding credit or offset it against future credits.

4.3

We may change the discount rate for the future, giving at least 30 days' notice in text form. In this case, the Creator may terminate participation with effect from the date of the change.

05Payout and taxes

5.1

The Creator can use the credit for our services or request a payout at any time via the support ticket system. Payouts are made by bank transfer to an account in the Creator's name. We may request proof of identity and the information required for tax purposes before making a payout.

5.2

The Creator is solely responsible for paying any taxes and social security contributions on the remuneration. If the Creator is an entrepreneur, they must inform us of their VAT status before the first payout; payouts to entrepreneurs are made by credit note (Section 14 (2) of the German VAT Act), plus VAT where applicable.

06Advertising rules

6.1

The Creator must clearly label all content in which they recommend our services with their code as advertising (e.g. "Advertisement" or "Ad"), in accordance with the applicable law and the rules of the respective platform.

6.2

Statements about our services, prices, availability and performance must be truthful and must not be misleading. The Creator may not make promises on our behalf, in particular regarding guarantees, availability or support.

6.3

It is prohibited to distribute the code by means of unsolicited messages (spam), to place paid search engine ads on our brand names, to impersonate ECSO CLOUD or to create the impression of an official partnership beyond the Creator Program. Our logos and brand assets may only be used in the form we provide.

07Violations

If the Creator violates these terms, we may block the code, cancel credits obtained through the violation and terminate participation without notice. Further claims remain unaffected.

08Term and termination

8.1

Participation is for an indefinite period. Both parties may terminate participation at any time in text form without giving reasons.

8.2

Upon termination, the code is deactivated. Credit already earned for paid invoices remains in the customer account and can still be used or paid out in accordance with Section 5.

09Data protection

The Creator only receives aggregated statistics on the use of their code, such as the number of uses and the credit earned. We do not disclose any personal data of customers to the Creator. Information on how we process the Creator's data can be found in our Privacy Policy.

10Final provisions

Participation in the Creator Program does not establish an employment relationship, partnership or agency relationship. In all other respects, the provisions of our Terms of Service apply, in particular those on liability, applicable law and place of jurisdiction.
